Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website located at Roastable.com (the “Site”) and all related services, features, content, and applications (collectively, the “Service”) operated by Roastable.com (“Roastable,” “we,” “us,” or “our”), a sole proprietorship operated by Brandon Olson in the State of Wyoming, United States.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Roastable provides AI-generated personalized comedy roasts based on information voluntarily submitted by users, including but not limited to name, date of birth, and other personal details. The Service is intended solely for entertainment purposes.

FTC Disclosure: All roast content on Roastable is generated by artificial intelligence (specifically, Anthropic's Claude language model). “Bernie” is a fictional mascot character — not a real person. No human comedian writes or reviews individual roasts. The AI-generated content should not be interpreted as factual statements, professional advice, psychological evaluations, or assessments of character.

The content has no scientific, psychological, or medical basis. Personality traits referenced in roasts are derived from entertainment-oriented systems (numerology, zodiac, etc.) and are not validated assessments.

3. Account and Registration

You are not required to create an account to use the Service. When you purchase a roast, you provide personal information that is associated with your order. You are responsible for the accuracy of the information you provide. You agree not to impersonate any person or entity or provide false or misleading information.

4. Purchases and Payment

Certain features of the Service require payment. By submitting a purchase, you agree to pay all applicable fees as described on the Site at the time of purchase. All prices include any applicable taxes unless otherwise stated at checkout.

All payments are processed through Stripe, Inc. (“Stripe”), a third-party payment processor. Your payment information is transmitted directly to Stripe and is subject to Stripe's terms of service and privacy policy. Roastable does not store, process, or have access to your full credit card number or payment credentials.

All prices are listed in United States Dollars (USD) unless otherwise stated. Prices are subject to change at any time without prior notice, but changes will not affect orders that have already been completed.

You represent and warrant that you have the legal right to use any payment method you provide in connection with a purchase.

5. Refund Policy

Roastable offers a 90-day money-back guarantee on all paid roast purchases. If you are dissatisfied with your purchase for any reason, you may request a full refund within 90 days of the original purchase date by contacting us at [email protected].

Refund requests will be processed within 5–10 business days. Refunds will be issued to the original payment method.

Roastable reserves the right to deny refund requests that appear to be fraudulent or abusive — for example, repeated purchases and immediate refund requests from the same individual. If your refund request is denied, you will receive an explanation by email and may appeal by responding to that email within 14 days.

6. Gift Purchases

The Service allows you to purchase a roast as a gift for another individual. When purchasing a gift roast, you provide only your name, your email address, the recipient's first name, and the recipient's email address.

Recipient Consent: The recipient is sent an email inviting them to claim their gift roast. The recipient must voluntarily choose to visit the claim page, provide their own personal details (last name and date of birth), and affirmatively click to generate the roast. No roast is generated until the recipient completes this process. If the recipient does not wish to participate, they can simply ignore the email — no personal data is collected and no roast is created.

Age Requirement: Gift recipients must be at least 18 years of age. By purchasing a gift roast, you represent and warrant that to the best of your knowledge, the recipient is at least 18 years old.

By purchasing a gift roast, you represent and warrant that you have a good-faith relationship with the recipient and that the gift is intended in good spirit for entertainment purposes. You may not use the gift feature to harass, stalk, bully, or otherwise target any individual. Roastable reserves the right to refuse or cancel gift purchases that appear to violate this provision.

7. User Conduct

You agree that you will not use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Submit false, misleading, or fraudulent information
• Harass, abuse, threaten, or intimidate any individual using the Service or its output
• Use the generated content to defame, libel, or harm the reputation of any person
• Present AI-generated roast content as a factual or professional assessment of any person
• Attempt to reverse-engineer, decompile, or disassemble any portion of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service, its servers, or any related systems
• Use automated scripts, bots, or other means to access or scrape the Service
• Circumvent any security measures or access restrictions implemented by the Service

8. Reporting Harmful Content

If you receive a roast that you believe contains content that is threatening, discriminatory, or otherwise harmful beyond the scope of comedy entertainment, you may report it by emailing [email protected] with the subject line “Content Report” and your roast ID (found in your roast URL or confirmation email).

We will review reported content within 5 business days and, where appropriate, may remove or modify the content and issue a refund. We take reports seriously and use them to improve the quality and safety of our AI-generated content.

9. Intellectual Property

Our Content: The Service, including but not limited to its design, layout, graphics, logos, trademarks, code, and all other content created by Roastable, is the property of Roastable and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our proprietary content without our prior written consent.

Your Roast: Upon completion of a paid purchase, you are granted a non-exclusive, perpetual, worldwide license to use, share, reproduce, and display the roast content generated for you for personal, non-commercial purposes. You may share your roast on social media, with friends, or in other personal contexts. You may not resell, sublicense, or commercially distribute the generated content without our prior written consent.

10. AI-Generated Content Disclaimer

All roast content is generated using artificial intelligence (Anthropic's Claude). Your date of birth is processed locally on our servers to derive non-personal, esoteric data points (such as numerological values, zodiac associations, elemental affinities, age bracket, and personality archetypes). Only your first name, age, and these derived non-personally identifiable data points are transmitted to Anthropic for content generation. Your last name, date of birth, email address, and other personal details are not shared with AI providers.

The generated content is intended solely for entertainment purposes. Roastable makes no representations or warranties regarding the accuracy, completeness, or appropriateness of AI-generated content. Generated content may contain observations, humor, or commentary that is subjective in nature. Such content does not reflect the personal opinions of Roastable, its owner, or its affiliates.

Content Warning: Roast content is intentionally edgy comedy. It may include humor about personality traits, life choices, habits, or personal characteristics that some individuals may find uncomfortable or offensive. The Service is not appropriate for individuals who are sensitive to personal humor or who are experiencing mental health challenges that could be exacerbated by comedic criticism.

You acknowledge and agree that AI-generated content may occasionally produce results that are unexpected, inaccurate, or offensive. Roastable is not liable for any emotional distress, offense, or other harm arising from the content of a roast that you voluntarily requested. If you are concerned about mental health, please reach out to a qualified professional.

11. Copyright and DMCA

Roastable respects the intellectual property rights of others. If you believe that content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) by emailing [email protected] with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of where the allegedly infringing material is located on the Service
• Your contact information (name, address, phone number, email)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
• Your physical or electronic signature

We will respond to valid DMCA notices within 10 business days.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROASTABLE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ROASTABLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROASTABLE, ITS OWNER, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL ROASTABLE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO ROASTABLE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

14. Indemnification

You agree to indemnify, defend, and hold harmless Roastable, its owner, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your violation of any rights of a third party; or (c) your sharing, distribution, or use of generated roast content in a manner that causes harm to any individual.

This indemnification obligation does not apply to claims arising from Roastable's own negligence, willful misconduct, or breach of these Terms. Your indemnification obligation is limited to the greater of (i) the amounts you have paid to Roastable in the 12 months preceding the claim, or (ii) $100 USD.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Informal Resolution First: Before filing any formal legal proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly this way.

Small Claims Court: Either party may bring a qualifying claim in small claims court in Laramie County, Wyoming, or in the county where you reside, without first engaging in informal dispute resolution.

CLASS ACTION WAIVER: YOU AND ROASTABLE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

If informal resolution and small claims court are not applicable, any dispute shall be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

16. Force Majeure

Roastable shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, power outages, pandemics, labor disputes, or third-party service provider outages. During any such event, Roastable's obligations are suspended until the event is resolved.

17. Third-Party Services

The Service relies on third-party providers for payment processing (Stripe), AI content generation (Anthropic), email delivery (Postmark), hosting (Vercel, Supabase), analytics (Plausible), rate limiting (Upstash), and error monitoring (Sentry). Your use of the Service is also subject to the terms and privacy policies of these providers. Roastable is not responsible for the acts or omissions of third-party service providers. 18. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

19. Modifications to the Service

Roastable reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, temporarily or permanently, with or without notice. Roastable shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

20. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where required by law, provide additional notice (such as via email or a prominent notice on the Site). Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

21. Accessibility

Roastable is committed to making the Service accessible to all users. We strive to follow the Web Content Accessibility Guidelines (WCAG) 2.1 at the AA level. 22. Severability

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Roastable regarding the Service and supersede all prior agreements, representations, and understandings.
